This is a huge red flag. While we don’t know the poster’s location, this kind of infidelity clause would be unenforceable in a place like California. In fact, it’d likely void the whole prenuptial agreement in the case of a divorce. To avoid situations like this, it’s usually best to draft your prenup with an attorney. It may not be the cheapest upfront choice, but it could save you money and headache in the long run.
